According to the road traffic act the vehicle is not classifed as being driven for multiple reasons, the key not being in the ignition for example. Looking at your phone in a car that is not being driven is not illegal, it is only illegal if, moving or not, it is being driven. https://www.legislation.gov.uk/ukpga/1988/52/contents
