Original Note:
The Supervisory Boards of Maricopa and Pima county are waiving a brief in opposition (BIO). The assertion that waiving a BIO means the defendants accede to the claims is false. BIOs are *not* mandatory except in capital cases or when requested by the court. https://www.law.cornell.edu/rules/supct/rule_15#:~:text=A%20brief%20in%20opposition%20to%20the%20petition%20for%20a%20writ%20of%20certiorari%20may%20be%20filed%20by%20the%20respondent%20in%20any%20case%2C%20but%20is%20not%20mandatory%20except%20in%20a%20capital%20case%2C%20see%20Rule%2014.1(a)%20or%20when%20ordered%20by%20the%20Court
