RICO violations are crimes. While OP is partly correct in that a RICO prosecution must show that someone at an organization committed prior racketeering crimes, a person involved with that organization need not have participated in those crimes to be guilty of a RICO offense. https://www.law.cornell.edu/uscode/text/18/1962
