There are, in fact, several rules governing the conduct of war under international law (https://www.icc-cpi.int/sites/default/files/RS-Eng.pdf) Those suspected of violating the laws of war can be and have been charged or convicted (https://www.icc-cpi.int/cases?page=0) OP may argue these laws shouldn’t exist, but that doesn’t change the fact that they do.
