Not misleading. That fact that you have penalty fees for having your product on a different market, is anti competitive. https://en.wikipedia.org/wiki/Anti-competitive_practices#:~:text=Anticompetitive%20behavior%20refers%20to%20actions,advantage%20or%20dominate%20the%20market. If they had generally increased fees in standard terms, and offered discount for exclusivity - that would been appropriate.
