Just because Gary Gensler and the SEC call and asset a security, does not make it a security. Here is the SEC admitting that a judge will decide if their theory is even applicable or not: https://pbs.twimg.com/media/FyW0mAXWcAA2nPY?format=jpg&name=small It is disingenuous of Gensler to speak as though this has already been decided in courts.
