憲法20条3項等に規定される政教分離原則については様々な学説がありますが、代表的な判例である津地鎮祭訴訟（最大判昭52.7.13）では、国家が宗教とのかかわり合いをもつことを全く許さないとするものではないとしています。 https://www.courts.go.jp/app/hanrei_jp/detail2?id=54189 上記訴訟では、神式で行われた地鎮祭に自治体の公金が使われたことが政教分離原則に反するかが争われましたが、最高裁は政教分離原則に反しないとの判断を下しました。 この判例および最高裁が示した判断基準に照らせば、宗教指導者の死去に際し総理大臣が弔意を表するだけであれば、それが政教分離原則に反する行動とは言い難いでしょう。
